Taking Liberties

Riding in on a wave of optimism and real belief in their mantra that things can only get better, the New Labour government proceeded to enact some of the most authoritarian legislation in recent history. With fast-paced satirical style, this Bafta-nominated film shows how, in just over a decade, some rights and freedoms that took centuries to build up have been rolled back or cut away through a personal journey into the decline of civil liberties.

The 82-year-old holocaust survivor Walter Wolfgang was lifted bodily from a debate at the Labour Party conference for, as Tony Benn points out, 'rightfully' saying that Jack Straw is talking 'nonsense' about Iraq. We see a man who tries to protest against the treatment of Mr Wolfgang also set upon by security, and learn that he was later handled roughly - and that poor old Wolfgang was next detained by the police under the 2000 Terrorism Act.

We meet Moulad Sihali, an Algerian refugee. He was cleared of all charges relating to a non-existent plot to manufacture the poison ricin, but has now been made a prisoner in his own home. He's been fitted with a tracking device, is only allowed outside at certain hours - and then only within a one mile radius of his house - and is forbidden to meet anyone who hasn't been vetted by the Home Office. The specific charge against him? There isn't one.

We hear how Maya Evans, a vegan chef, and her friend the writer Milan Rai were arrested under the Serious Organised Crime and Police act for reading out the names of people who have died in Iraq and occasionally ringing a (very quiet) Buddhist bell.

Occasionally the footage is very funny. Protestors are told that if they step off the grass verge they have been crowded onto they could be arrested for blocking a public highway. They are told this by a massed group of policemen who are actually blocking the road.

There are recordings of the police intimidating grandmothers; protestors being strong-armed; 80-year-olds being dragged along on their backsides by police; Tony Blair staring on silently (in contravention of international law against complicity with torturers) as George W. Bush praises the facilities at Guantanamo Bay.

The documentary even succeeds in arousing sympathy for a group of bankers - the Natwest Three. Thanks to a 2003 treaty they were extradited to the US - for a crime they allegedly committed in Britain but that British authorities declined to prosecute due to lack of evidence. In this case, the US authorities were allowed to take these men from their homes and support networks without presenting any new data to the British government.

  4. A truly shocking programme. It is how the Nazi regime started. We must all be very vigilant about this stuff. Very hard when laws are passed in secret. A democratic government? I don't think so.

  5. If you abhore lying politicians, bad laws, unecessary secretismand being monitored, processed and controlled by often questionable employees, then you MUST watch this programme. It details with clarity and wit the official hypocrits who are removing our human and democratic rights. It further does what excellent TV should do, it suggests what could be done by each and every one of us. If you care about living in a democracy under a just moral code, this programe is a must see. Very well done and a massive thankyou to the makers. 10/10

  6. I was shocked and appalled watching this programme. I have obviously had my head in a bucket all this time - where have our rights gone? I couldn't believe my eyes watching people in their twilight years being hauled around like lumps of coal. My father who fought for our freedom in the second world war must be spining in his grave. As a nation we have always kept our cool during attacks from whatever quarters but now we seem to be panicking at the slightest issue - and overreacting like our friends across the pond. What next? Guns bought over the counter? God help us

  8. one truly jaw dropping moment for me was an interview with Tony Blair at about 46 minutes in when he's talking about the early detection and prevention of crime caused by children from dysfunctional families, the interviewer asked when this should start as some of these children should really be in nappies at the time and without batting an eyelid Mr Blair responded with "or pre birth even" I'm sorry but I thought selective breeding and eugenics died with the Nazis at the end of world war 2, I may not be the biggest fan of my neighbours offspring but I wouldn't presume the right to prevent my neighbours having children on the grounds that the child may grow up to commit a crime Magna Carta guarantees us the right to due process the home secretary can now override Magna Carta and have you detained indefinitely without charge, right of appeal or even the chance to have your case heard in a court, all based on evidence prepared by a third party who may not include every detail such as the minor item that you are innocent of any wrongdoing the 2003 extradition act effectively puts every UK citizen under the jurisdiction of US federal law, don't worry about losing sovereignty to Europe we've already ceded it to America we can't lose what we no longer have and as far as protesting, the message I'm getting from the government is "yes you can protest, but you should be fearful of the possible consequences" this is my country but I don't want to live in it any more I took part in the democratic process and the country elected a government that I am now frightened of this is wrong and I don't know how to fix it

  9. I missed the broadcasts of this programme and my other half thought he had recorded it for me but failed. Hope it gets shown again - I cannot find it on any future tv listings. This is the type of subject that the old "Panorama" used to do so well!! We are NOT living in a free society nor do we have Freedom of Speech - this subject should be aired much more than it is.

  10. This is a wonderfully enlightening programme - I was fascinated and horified at the same time! How come these events didnt make the news at the time they happened, I remember seeing a little of what happened to Walter Wolfgang but that was heavily edited (not in his favour), I had been blissfully unaware of the other occasions until now. This programme is prime time, channel 4 material and then should become part of the National Curriculum in British schools.

  13. Max, that's horrible, we can't even go about our lives without being harassed by the police! The same thing happened to a friend of mine. I assume these are random checks, but it is a little over the top! They should only have the power to stop people committing crimes, not to invade our peace and privacy. This show has opened my eyes, I didn't know that it was this bad in our own country. The government and the police need to remember who is running this country, it's the people, not them! We put them there, and we can remove them. I think it's time to make them understand that they cannot just do whatever they please, but have to ask us first. We need more people to stand up the these cowards and voice their opinions. We need to get into action and change this situation before more innocent people are made to suffer from the government's paranoia.

"Worrying isnt it makes you wonder who's reading this im in my earliy 20's and have a great intrest in politics unfortinatly i feel the problem is with my geniration 90 per cent of people i know either cant be bothered or dont care about politics which is the atitude i belive has got us here ive never protested in my life but feel that the people who do do a very valuebal service to our contry "peacefuly of coure" I also have great admiration for the service men and women in the militery who have been let down again and again and some times tared with the same brush as the americans"

  16. This is a timely film and one which deserves a lot wider viewing. I only stumbled across it by chance but feel that everyone in the UK needs to see it. I feel that it is already impossible to get back the freedoms we have lost and feel so powerless as an individual to do anything to change matters. Our elected representatives have proved utterly spineless in defence of our freedoms and a change of government will do nothing to improve this situation. I feel sad for my children who will have to live in a country without the basic freedoms that I have taken for granted all my life

  17. I served as a soldier for 13 years. My job was to not to kill but to protect freedom, democracy and human rights. I was always prepared to lose my life to protect those beliefs. It is clear that there has been a systematic break down of our basic human rights and freedoms by the Labour Government. They are completely responsible for this yet remain unaccountable in any way. When will they start answering our questions! The actions taken by US soldiers at Guantanamo Bay on "detainees" (apparently NOT prisoners - what is the difference)is unforgiveable and not that of a professionally trained soldier. The Police have clearly lost sight of how to use their skill to protect the public and seem to hide behind ridiculous laws. Why can they not use discretion and work within the letter of the law. It is clear that if nothing is done then our freedom to protest and rights to justice and fair trial will soon erode away. In fact, it seems that the damage already caused by developing a policed state is not far from being irreversable. I was deeply disturbed by the documentary and I think that in order to preserve our future and our childrens human rights then something must absolutely change. It seems that the fact remains that an innocent protester could be arrested without charge under the current terrorism act and potentially be placed under house arrest also, British citizens can be sent to another country, again without charge, away from their families to await trial for what! Tony Blair is weak as is the current labour government and someone needs to start answering questions. I was proud of my service for my country but at the age of 41, I am deeply worried for the future of the British Public and for anyone who resides in our country. I absolutely stand against the current governments policies or any government which follows the same.

  19. Absolutely shocked at the incredulous behaviour of the police in denying people the right to demonstrate. Years ago i used to hear a common phrase 'Its a free country.' Probably not so strange that I've not heard this for at least a decade.

  22. Looking forward to this program. I was in London on a training course for a week. I was stopped by the police and searched whilst looking for somewhere to eat in the afternoon. I was asked what I was doing in London, where I was going, where I was from, how long I was staying for. They went through my wallet and said they stopped me on suspicion of terrorism. I'm a 40 year old Caucasian.
