Divorce: Jewish Style

In Jewish law, it is the husband's right to decide whether he will give his wife a divorce, called a Get.

If he refuses her, the wife may be sentenced to years of living in a dead marriage.

She cannot remarry in the Orthodox Jewish way, and any child she has from a new relationship is considered illegitimate. In Hebrew, she is called an Agunah: a 'chained woman'.

With rare access to the Orthodox Jewish community, both here in the UK and also in Israel, this film explores the controversial world of Jewish divorce to find out why these apparently outmoded laws still hold sway.

  1. The programme did not lay sufficient emphasis on the problems of men whose wives refuse to receive the GET. One example was given, in which the rabbinical court 'got round' this problem by making a negative implication against the alleged behaviour of the woman. But what happens if the woman is seen by the rabbinical court as dressing modestly etc, and they cannot make any such implication? In this case the man is 'chained' just as much as a woman whose husband refuses to give the GET. The final 'what happened afterwards' frames show the woman concerned as "having now received a normal GET". This is a misrepresentation in that she always could have received a normal GET but refused to accept it.

  2. I know from experience the only reason that men withold the Get is control and remorse. It is the only tool they think they have for this rejection. They should look deeper at the reasons for their civil divorce and not bury their heads in the sand. The laws should change to either matching the punishment with Israel or simply abolishing this rediculous and archaic law completely.

  5. i blogged on this very subject over here http://hadassahsabo.wordpress.com/2009/07/31/the-chains-that-bind/ in this day and age it is heinous that women are subjected to men's wishes in the case of religious divorce. that they are chained, unable to move on, at the whim of an ex spouse. it is a sorry state of affairs when a woman has to compromise her religious beliefs in order to obtain that which should have been hers as soon as the couple decided to separate.

  6. I think it is very sad that control is exercised by the man by refusing to give a get. The marriage has clearly dissolved. I would think common sense and the spirit of harmony ought to prevail to enable both parties to a dissolved marriage to move forward with life in a positive manner. One should be able to do this without having to compromise one's commitment to orthodox judaism. This situation saddens me. I hope that a fair resolution will ultimately prevail.
