Housing Horrors Video Terms and Conditions

Channel 4 is asking for people to submit videos on YouTube to our housing horrors page on YouTube. Please read these terms and conditions first.

You must make sure your video complies with the rules below ("Rules") and by submitting a video you agree to and will comply with the Rules and Channel 4's terms and conditions and Channel 4's Off Network House Rules (together the "Online Terms") and YouTube's terms and Community Guidelines (together the "YouTube Terms"). If you do not agree to any of these, please do not submit a video.

The Housing Horrors Page is operated and managed by or on behalf of Channel Four Television Corporation ("Channel 4", 'our', 'we' or 'us'). In the event of any conflict between the Online Terms and the YouTube Terms then, as between you and Channel 4, the Online Terms shall prevail in respect of your submission of your video to the Housing Horrors Page.

Submission Process

1. First of all you will need a YouTube account and then upload your housing horrors video to your own YouTube channel. You will then need to submit your video to our Housing Horrors Page.

2. Not all videos submitted to the Housing Horrors Page will be displayed and Channel 4 reserve the right to use and display on our Housing Horrors Page such videos as we may decide from time to time and may remove these from display at any time.

3. Channel 4's and the relevant production companies (each a 'Producer') producing the applicable programmes on Channel 4's behalf (each a 'Programme') decisions in relation to use of the videos and selection of videos (if any) are final and they will not be required to enter into any discussion or correspondence about why a video has been selected or rejected to feature in our Housing Horrors Page and/or used in a Programme.

Videos – Important Requirements

1. You (and anyone who appears in the video) need to be at least 18 years old.

2. You must have the consent of all the people who feature in your video and they must all be happy to be part of your video.

3. Everything you submit must be your own work and not copied from anyone else. If you include anyone else's material in your video, you must have obtained their permission to do so. If you don't, you will be infringing the copyright in the material.

4. Do not secretly film anyone or infringe anyone's right to privacy.

5. Do not include anything that is obscene, indecent, harassing, threatening or liable to incite racial hatred.

6. Do not mention any court cases or arrests as this may constitute a contempt of court.

7. All facts in your video must be true and any opinions must be your own and genuinely and truly held by you.

8. Do not say untrue things about people or companies, including landlords or any tenancy agency, as this may be defamatory.

9. Do not give your home address in your video clip or show any way in which your address could be identified.

10. Do not feature any music in your video.

11. Other people will be able to view your video, so don't reveal anything personal about you.

12. You should aim to make your video no more than 2 minutes in length.

13. You can use any means to film your video, whether it's with a video camera, webcam or phone. But the higher the quality the better. Make sure the lighting is ok and there is no background noise.

14. The Housing Horrors Page is expected to remain open for videos from 27 June 2011 to October 2011 (although these dates may be moved at Channel 4's discretion). Channel 4 may withdraw, cancel or amend the submission process and/or Housing Horrors Page without prior notice, for example to ensure compliance with legal, regulatory or other similar requirements or for any reason outside Channel 4's control.

15. You may submit as many videos as you like provided they comply with the Online Terms and YouTube Terms.

You and Your Videos

1. Personal information collected by Channel 4 will be used and collected in accordance Channel 4's Privacy Policy (http://www.channel4.com/privacy.html). Please note that by submitting a video you consent to a Producer contacting you using your details provided and/or YouTube's functionality.

2. Channel 4 does not claim any rights of ownership in your video. As such, you retain ownership of your video and, subject to any licence granted to a Producer and Channel 4, you will also have the right to use your video in any way you choose.

3. Channel 4 does not guarantee to use or otherwise include any video in a Programme and may, at its sole discretion, reject, edit and/or remove videos that appear to be legally or otherwise problematic e.g. infringe the copyright or other intellectual property or privacy rights of others, are defamatory etc. or for any other reason.

4. Your video and any information submitted by you must be personal to and relate specifically to you. You hereby warrant that your video and all information which you submit will not infringe the intellectual property, privacy or any other rights of any third party, and will not contain anything which is libellous, defamatory, obscene, indecent, harassing or threatening and will comply with the Channel 4 Off Network House Rules. Channel 4 reserves the right, but not the obligation, to screen, filter and/or monitor information and/or videos provided by you and to edit, refuse to use or remove the same.

5. Channel 4 does not accept any responsibility for any damage, loss, injury or disappointment suffered by you through the Housing Horrors Page or as a result of any video. Channel 4 is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment or software, failure of any email or video to be received on account of technical problems or traffic congestion on the Internet, telephone lines or at any web site, or any combination of these, including any injury or damage to your any other person's computer or mobile telephone related to or resulting from participation or downloading any materials from YouTube. Nothing shall exclude Channel 4's liability for death or personal injury as a result of its negligence.

6. These Rules are governed by English law and any disputes will be subject to the exclusive jurisdiction of the courts of England.
