Do clamps breach human rights?

Wheelclampers are acting illegally by imposing exorbitant charges for the release of cars parked on private land, according to the RAC foundation.

Following a review of private property parking regulations, they say that clamping vehicles on private land could breach human rights - as the punishments of clamping and fines are handed out without a proper legal process.
In 2007, councils in England and Wales were banned from using wheelclamps except in exceptional circumstances, but that did not cover clampers working on private land.
