Sending troops into battle without the right equipment could breach their human rights a judge rules today.

In a test case over the death in Iraq of Scottish soldier Private Jason Smith, Mr Justice Collins said service personnel were entitled to a measure of legal protection wherever they were.

He also said families of soldiers killed on active duty would be entitled to legal aid and more access to military documents.

The Defence Secretary Des Browne plans to appeal.
