Protest blocked
Iraq

Published: 05-Sep-2003
By: Simon Israel

Just how important is the freedom of speech? Just days into the war in Iraq, three coachloads of peace protestors left London for RAF Fairford - but they never arrived.

Why? Because police first detained them - and then turned them back.

Now they've been granted permission for a judicial review - because the police may have breached their human rights.

It was the first week of the war and on the M4 some 120 anti war protestors were heading for the US airbase where many of the bombing missions were being launched from.

Police blocked them with stop and search on a grand scale - five miles from the anti war rally at RAF Fairford. They said they were looking for offensive weapons.

Among the items confiscated were scarves, paper overalls, pieces of foam, some toy soldiers, a hammer, a frisbee and a saw.

Having been debagged, the protestors got back on board. On to the rally then? No, not this time.

Their way to the rally was barred. This action which may prove to have been illegal.

A High Court judge has granted the demonstrators a judicial review. They say the police breached their fundamental rights to freedom of assembly and freedom of expression by barring their way to the rally.

In a statement Gloucestershire Constabulary issued a statement on behalf of itself - but there are implications for 6 other forces:

Thames Valley Police

Metropolitan Police

West Mercia Constabulary

Northamptonshire Constabulary

Avon and Somerset Constabulary

Devon and Cornwall Constabulary

Gloucestershire Constabulary said:

"We are aware that a judicial review has been ordered and the Constabulary intends to defend its actions."
