
These are the terms and conditions for participation in the nominations element of The F Word's Best Local Restaurant 2009 ("The F Word’s Best Local Restaurant")
This nomination process (the "Nominations") is organised by Optomen Television Limited ("Optomen", "we"or "us") whose principal place of business is at 1 Valentine Place, London SE1 8QH.
The nomination criteria and the judging criteria are incorporated in these terms and conditions.
To make your nomination(s) you must complete the nomination form. This is free of charge but please be aware that depending on your method of Internet access you may be subject to local call charges. There are no alternative nominating methods.
You may nominate as many local restaurants ("Nominee") as you like but if you nominate a restaurant more than once your nomination may not be considered. Each nomination must be made by a separate nomination entry. You may nominate a restaurant that you personally own, work for or have a commercial or family interest in but we ask that you make this fact known to us when nominating.
The Nominations will open on 17th June 2009 and continue until midnight on 26th July 2009 (the “Nomination Period”). Nominations received outside of the Nomination Period (for whatever reason) may be deemed invalid. We reserve the right to extend the Nomination Period provided we post the change on the Channel 4 Website.
All participants must be over 18 years of age at the date of entry and resident in the UK.
All participants using the internet to nominate must have the bill payer's permission prior to entering.
Employees of Channel 4 Television Corporation (and its group companies), Optomen Television Limited (and its group companies) and Gordon Ramsay Holdings Limited (and its group companies) may be excluded from nominating a restaurant and your nomination may not be considered. All restaurants within the Gordon Ramsay Holdings Limited group of restaurants are excluded from the Nominations and their nomination will not be considered.
The eligibility of any nomination or Nominee is at the sole discretion of Optomen.
At the end of the Nomination Period all the local restaurants nominated in accordance with the Nominating Criteria, and these Terms and Conditions, will be assessed by our panel (consisting of Gordon Ramsay, a representative of Channel 4 and a senior member of Optomen's production team) according to the Judging Criteria. The best restaurants in each food category ("the Selected Nominee") will be filmed for possible inclusion in the next series of Gordon Ramsay's The F Word due to be broadcast from November to January 2010 subject to certain verification checks including meeting the Judging Criteria and confirmation that the Nominee wishes to participate in the Programme and the Nominee signing a release form. The decision of Optomen is final and no correspondence will be entered into.
Each nominated restaurant must be able to provide two chefs to take part in filming for the Programme and they must be available on all possible filming dates proposed by us.
Each nominated restaurant must provide a telephone number, preferably a number for a mobile telephone, and be available for a telephone interview at a time specified by Optomen.
The Selected Nominees for each of the 8 (eight) food categories may feature in each of the first eight episodes of the Programme in which further assessment of the Selected Nominees will be made by Gordon Ramsay. Gordon Ramsay will decide upon the Winner after putting the Selected Nominees through a number of food and/or restaurant related tasks. All the Selected Nominees will be dealt with equally and fairly during the course of the Programme. The winner will be declared in the final Programme of the series as the Winner of The F Word's Best Local Restaurant 2009. The decision of Gordon Ramsay is final and no correspondence will be entered into.
All the Selected Nominees will undergo a verification process before appearing on the Programme; failure to participate in the verification process may render the Selected Nominee ineligible to take part. The Selected Nominees will be required to sign a contributor release form where they will need to agree to terms that include:
(a) they are willing to be filmed for inclusion or otherwise participate in the Programme. Optomen makes no assertions as to whether or not any such Programme will be made nor is Optomen under any obligation to feature any such Nominee;
(b) they agree not to make any statements regarding this competition or the Programme to any representative of the media or the press without Optomen's prior written consent; and
(c) the Chefs taking part in the Programme and the owner(s) of the restaurant are over 18 years of age, do not have any criminal convictions and are not (from the date of nomination to the date of broadcast) under any criminal investigation.
Optomen reserves full editorial control of the Programme. Optomen reserves the right to remove and/or moderate any and all material in the Programme but Optomen has no obligation so to do.
Use of personal data received by Channel 4 or by Optomen in the course of the Nominations and the production of the Programme are subject to Channel 4's privacy policy which can be found at www.channel4.com/privacy.html. Optomen may use the nominating person's and the Nominee’s personal details to operate the Nominations and produce the Programme and we may contact you by email or telephone regarding your nomination. Optomen will ensure that any personal information collected from the Nominations and/or the Channel 4 Website will be used in accordance with the Data Protection Act 1998. All the nominating person's information will be kept securely and treated as confidential (except as set out above or where we agree otherwise with you e.g. in relation to contacting you with information or offers regarding The F Word). You have the right of access to the information held and used by Optomen. By submitting the nomination form you are consenting to the use of your personal information by Optomen for the purpose of running the Nominations and producing the Programme. The name and address of Nominees and the information submitted about the Nomination, plus the nominating person’s first name may be included on the Channel 4 Website and mentioned in the Programme. You may also receive e-mail communications from Optomen alerting you to information and offers regarding The F Word unless you have indicated on the nomination form that you do not want to receive these emails.
Optomen, Channel 4 and/or their respective group companies and/or sub-contractors do not accept any responsibility or liability whatsoever for any technical failure or malfunction or any other problem in any telephone network or line, system, server, provider or otherwise which may result in any nomination being lost or not properly registered or recorded. Only nominations received in accordance with these terms and conditions will be acceptable.
In the event of any dispute regarding these terms and conditions, conduct, results or any fault, misunderstanding, mistake or dispute concerning the operation of a nomination, including the acceptability of any nomination, or the operation of any technical/communications system, Optomen's decision shall be final.
Nothing in these terms and conditions removes or limits our liability for fraud, for death or personal injury caused by our negligence or for any liability which cannot be limited or excluded by the law. These terms and conditions also do not affect the rights that are granted to you as a consumer by the law. Otherwise, we will not be liable to you for any matter relating to the nominations offered by us.
We will also not be liable to you if you suffer loss or inconvenience because of the failures of persons or systems that we do not directly control – for example, mobile phone network operators, internet service providers, software providers and telephone traffic handlers.
By entering the Nomination, you are deemed to accept these terms and conditions which form a legally binding agreement between you and us. Any breach of these terms and conditions by an entrant will void their nomination. Misrepresentative or fraudulent entries will invalidate a nomination. We reserve the right to change them and update them from time to time but if we do so we will post the changes on the Channel 4 Website.
These terms and conditions shall be governed by English law and are subject to the exclusive jurisdiction of the English courts.
