FLIX - LEGAL NOTICE, DISCLAIMER, AND TERMS OF USE

Access to and use the Flix mobile video service ("The Flix Service") is provided subject to these terms and conditions. PLEASE READ THESE TERMS CAREFULLY AS USE OF THE FLIX SERVICE CONSTITUTES ACCEPTANCE OF THESE TERMS AND CONDITIONS.

The Flix Service is being provided by Flix and the Channel Four Television Corporation and/or 4 Ventures Limited and/or Endemol UK PLC shall have no liability for any loss or damage caused directly indirectly or otherwise by the Flix Service.

USE OF MATERIAL ON THE FLIX SERVICE
The information, artwork, text, video, audio, or pictures (collectively, "Materials") contained on the FLIX SERVICE are protected by copyright laws. You may only access and use the Materials for personal or educational purposes. You may not modify or use the Materials for any other purpose without Flix's express written consent. Except as provided below, you may not reproduce, republish, post, transmit or distribute any Materials on the FLIX SERVICE.

Any computer / phone software downloadable or otherwise available from the FLIX SERVICE is licensed subject to the terms of the applicable license agreement. In order to activate THE FLIX SERVICE you are required to download player software for which you will be charged a one off fee of £2.00 (two pounds). The price payable for Materials viewed by you will be displayed before you choose to download the Materials.

The Materials included on the FLIX SERVICE have been compiled by Flix from a variety of sources, and are subject to change without notice.

All media files on the FLIX SERVICE are protected by copyright laws. You may not, under any circumstances, reproduce, record, publish, publicly exhibit, or distribute any media files (including, but not limited to, .mvq files) made available for playback on the FLIX SERVICE without Flix's express written consent. You may not link directly to any .mvq file located on a Flix server, and you should not attempt to use any of Flix's content as your own work.

DISCLAIMER OF WARRANTY
The services, information or data, including but not limited to the Materials (collectively, "Information") made available on the FLIX SERVICE are provided "AS IS", without warranties of any kind. Flix expressly disclaims any representations and warranties, including without limitation, the implied warranties of merchantability and fitness for a particular purpose. Flix shall have no liability in connection with the services including without limitation, any liability for damage to your computer / phone hardware, data, information, Materials and business resulting from the Information on the Flix service.

Flix shall have no liability for any loss or damage caused, in whole or in part, by its actions, omissions, or negligence, or for contingencies beyond its control, in procuring, compiling, or delivering the Information;

Flix shall have no liability for any errors, omissions, or inaccuracies in the Information regardless of how caused, or delays or interruptions in delivery of the Information or for any decision made or action taken or not taken in reliance upon the Information furnished hereunder.

Flix makes no warranty, representation or guarantee as to the content, sequence, accuracy, timeliness or completeness of the Information or that the Information may be relied upon for any reason. Flix makes no warranty, representation or guarantee that the Information will be uninterrupted or error free or that any defects can be corrected. For purposes of this section, "Flix" shall include Goodane Ltd., and its divisions, subsidiaries, successors, parent companies, and their employees, partners, principals, agents and representatives, and any third-party owners, producers, providers or sources of information or data, including but not limited to the Materials.

LIMITATION OF LIABILITY
Under no circumstances shall Flix or owners or producers of any Materials be liable for any losses or damages whether direct or indirect whatsoever, whether in contract, tort or otherwise, from the use of, or reliance on, the Information, or from the use of the Internet generally.

PERSONAL INFORMATION
Goodane Limited will ensure that information provided by you for the purpose of accessing and using the FLIX SERVICE (if any) will be used in accordance with the Data Protection Act 1998. All information will be kept secure and treated as confidential. Any disclosures of information will only be made with your permission. You have the right of access to the information held and used by Goodane Limited.

If you give your approval, we may share your personal information with other companies in the Goodane Limited group or with other carefully selected companies with which we have a business relationship. Goodane Limited would like to retain your information for future related use and to contact you to request your consent to the use of your information for certain specified uses by Channel 4 and its group companies including 4 Ventures Limited and/or Endemol UK Plc (the owners and producers of the Materials). Only if you have signified your express consent, may we use your personal information to provide you with promotional information about new services and other services offered by us and other companies with whom we have a business relationship, including but not limited to Channel 4 and its group companies including 4 Ventures Limited and/or Endemol UK Plc. At any time, if you do not wish to continue receiving promotional information, you may notify us by email or by calling us whereupon we shall cease sending promotional information to you.
