Channel 4 Big Brother 7 video and streaming terms and conditions

These terms and conditions apply to your use of the Channel 4 Big Brother video clips and/or live video stream ("Content"). By viewing or accessing the Content, you agree to these terms and conditions of use.
1. Territory

The Content is currently only available for viewing in the UK and Republic of Ireland by UK and Republic of Ireland residents. You agree not to attempt to view or gain access to the Content from outside the UK and/or Republic of Ireland.

2. The Service

The Content will be made available for download or viewing by you once your payment has been authorised. Until your payment is authorised, we may decline to supply the Content to you. No contract will be entered into between you and Channel 4 unless and until you make payment for the Content.

Video clips - any Content that is made available for download or viewing by you will be available for multiple viewings over a 24 hour period from purchase of the Content.

Live video stream - any Content that is made available will be available for viewing by you over the period relevant to the pass you have purchased. These periods are as follows: "series pass" (during Big Brother series 7), "week pass" (168 hours from purchase of Content) and "day pass" (24 hours from purchase of Content). Details of when and how these passes can be purchased will be set out on the Big Brother website.

You are responsible for providing all equipment and software necessary for you to download, view and access the Content. You must ensure your equipment and software is compatible with the Content by using the test file. We will not be responsible to you if your equipment or software is not compatible with the Content.

3. Usage

The Content is the property of Channel 4 or its licensors and is protected by copyright law. You may use the Content only for your personal and non-commercial purposes.

Any copying, reproduction, lending or hiring, public performance, broadcasting or any other form of distribution of the Content (including peer to peer transfers) other than in accordance with these terms and conditions is prohibited and will constitute a copyright infringement. The Content contains security technology and carries an individual digital watermark which cannot be removed. You agree not to attempt to, nor assist any other person to, circumvent or remove the security technology or watermark.

You agree that the information which is used to watermark the Content is stored together with the information concerning your transaction which may be used in order to trace any infringement of copyright. You agree that this information may be disclosed to third parties if such disclosure appears necessary for the purpose of tracing copyright infringements.

4. Cancellation and Defective Content

You may not cancel any transaction after you have confirmed that you wish to purchase the Content and authorised payment. If you are unable to view the Content or complete the download process, or wish us to provide a replacement for a download that is defective, please contact our helpdesk by using the contact details below. Where this is due to our default, we will replace or refund the Content or download at our discretion.

5. Material in the Content

You understand that the Content may contain nudity or other material of a sexual nature, or may include content that you may consider offensive or otherwise objectionable. Although we will attempt to bring such material to your attention prior to completion of your transaction, you agree that we shall have no liability to you for any Content that may be found to be offensive or otherwise objectionable.

6. Payment

The price payable for Content is set out on the Big Brother website. If, by mistake, we have under-priced an item of Content, we will not be liable to supply that Content to you at the stated price, provided that we notify you before the Content concerned is downloaded by you. All prices are expressed inclusive of any VAT payable unless otherwise stated.

You can pay by Switch or any Mastercard or Visa credit card. Your card details will be encrypted to minimise the possibility of unauthorised access or disclosure. Authority for payment must be given at the time of order. You will be charged at this time. When you pay by card, 4.5% of the total cost is paid by you to Worldpay for card handling services.

We accept orders only from Web browsers that permit communication through Secure Socket Layer (SSL) technology, for example, 3.0 version or higher of Explorer and versions 3.02 or higher of Netscape.

7. Availability of the Service

We reserve the right to modify, suspend or discontinue the Content and the service provided to you under these terms and conditions (or any part of it) without notice to you and shall not be liable to you if we exercise these rights. You acknowledge that you may no longer be able to replace the Content if we discontinue this service and you agree that we shall have no liability to you in that event. Where commercially practicable, we will try to give you reasonable notice of any discontinuation of the Content.

We may prevent your access to the Content if you breach these terms and conditions.

8. Liability

The Content and the service provided under these terms and conditions is provided on an "AS IS" and "AS AVAILABLE" basis and Channel 4 makes no guarantees that the Big Brother website or the Content will be available, uninterrupted or error free, or that defects will be corrected, or that the Content, the Big Brother website or the server that makes it available are free of viruses or bugs.

Our liability to you in connection with any order will not exceed the total price charged for the relevant Content.

In no event will Channel 4 or our third party affiliates be liable for indirect or consequential damages, loss of use of the Content or the service provided under these terms and conditions or loss of data or profits, whether in action of contract, negligence or other action arising out of or in connection with the use of the Content. These exclusions do not apply to death or personal injury caused by Channel 4's negligence and only apply to the extent permitted by law. This does not affect your statutory rights.

9. General

These terms and conditions shall be governed by and construed in accordance with the laws of England and Wales and any disputes will be decided only by the English courts.

If any of these terms and conditions are held by any court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining terms and conditions which will continue to be valid and enforceable to the fullest extent permitted by law.

These terms and conditions also incorporate the channel4.com Terms and Conditions of use.

Except as expressly set out in these terms and conditions, all use of your personal information will be made in accordance with our Privacy Policy.
