The Game Guru competition ('the Competition') is a free to enter competition which is open to all users of 16 or older who have created their own original game ('the Users'). The Competition is run by Channel Four Television Corporation and/or its subsidiary 4 Ventures Limited, both of 124 Horseferry Road, London SW1P 2TX ('CH4' or 'We'). By sending in your game, or allowing your game to be submitted, and as a condition of participation, you (being the submitter and all members of the group if a group submission) hereby agree to abide by the terms and conditions of participation as set out below ('Terms and Conditions'). Users will also need to provide contact details and such proof of eligibility as may be requested.
TERMS AND CONDITIONS OF PARTICIPATION
1. All entrants to the Competition must be at least 16 years old. To be eligible for the Prizes you must be a resident of the UK. However, non UK Residents may participate in the Competition but shall not be entitled to the Prizes. Proof of age or residency may be required.
2. The Game ('the Game') you on behalf of yourself or your group ('You' or 'Your') send in or agree to being submitted by someone else must be of original work to You. If it is not original to You, You hereby warrant that You have permission from the person who owns the work and have obtained all necessary clearances. You may be required to show evidence of such permission and clearances.
3. If You do not have permission or falsely claim to be the owner of the of the Game (and any content within it), the entry will be disqualified. By agreeing to these Terms and Conditions You hereby warrant that all information submitted by You is accurate, current and complete.
4. The Games will only be accepted in the formats detailed elsewhere on this Web Site (as defined below). We will not accept Games by other means and cannot return or acknowledge any Games submitted in any manner.
5. You warrant that You own all copyright, recording and publishing rights in the Game or that You have the express written permission from the copyright, Game or publisher owner to make use of such material in the Games in this way.
6. You warrant that the Game and all materials contained in it are not defamatory of anyone or will infringe the right to privacy of any person and are not obscene or indecent.
7. By submitting the Game You give Us an irrevocable licence to use the Game in all media (whether now in existence or hereinafter invented) for the purposes of the Competition including but not restricted to on-line (i.e. web site), all forms of television, print publishing etc. throughout the Universe in perpetuity. You understand that your Game may appear on one or more areas of the channel4.com website (the 'Web Site').
8. You hereby indemnify Us against any claims of whatever nature that arise as a result of any breach by You of any of these terms and conditions or any warranty offered by You hereunder.
9. The Game will be put on the Web Site as soon as is reasonable for Us to do so (in our sole opinion) after You submit it. However We do not offer any warranties as to when the Game will be put on the site or whether it will be used at all.
10. We reserve the right to refuse to put up the Game without explanation to You. We will not put up any Games which in Our opinion breach these terms or are obscene, pornographic or not in good taste or of anyone who appears to be under 16 (sixteen), unless you provide official proof of age.
11. The Competition will end on 6th Novermber 2005 ('the Term'). At our discretion the Competition may be continued after the Term.
12. The Competition will be adjudicated at the end of the competition on 6th October 2005 (or the extended end date of the Competition) as the entry that is determined to be the best, as judged by US, at our sole discretion. In the event that any applicant is disqualified from the Competition, We in our sole and absolute discretion may decide whether a replacement winner should be selected. In this event, any further winner will be selected on the same criteria as the original applicant and will be subject to these Terms and Conditions.
13. Although the Winners' Game will remain on the Web Site for the Term (subject to CH4 right to remove the Games at any time in the event we believe the Game or you have breached or are likely to breach these terms), a Winner will not be entitled to the Winner's Prize more than once during the Term.
14. On notice from You by email, We will take down your Game if You so request.
15. The prizes ('the Prizes') will usually be as advertised on the Web Site. However We reserve the right to change the Prizes for any reason. Non UK Residents shall not be entitled to receive the Prizes.
16. We reserve the right to terminate the Competition at any time without notice or further recourse to You.
17. These Terms and Conditions and all other general terms of use of the Web Site ("General Terms") apply to Your use of the Competition. We reserve the right to modify the General Terms or these Terms at any time and without notice to You or any of its users. We may add to, change, delete or end our or Your use of the service at any time. The service may be temporarily unavailable from time to time for maintenance or other reasons.
18. The Winner will be contacted by e-mail and/or telephone as provided by You in the registration of your entry. We reserve the right to choose another Winner if you fail to accept the Prize within twenty four (24) hours of notification.
19. We are not responsible for communication, network, electronic or computer failures of any kind or for transactions that are misdirected, garbled, incomplete, delayed by computer transmissions or other communications systems, lost, late or damaged.
20. We offer no guarantees as to Your entry or continued participation in the Competition or any future earnings and reserve the right to refuse or reject any Games at any time at Our discretion.
21. We reserve the right to use the Winner's name and Game for publicity purposes and to announce it and use it on the Web Site and/or during television transmissions.
22. In the event of any dispute concerning the Competition, our decision will be final and no correspondence will be entered in to. We retain the right (at our sole discretion) to disqualify any entrant who fails to comply with these Terms and Conditions.
23. Neither We nor any other company or person connected with CH4 or the Competition shall have any liability or obligation to any entrant to the Competition for any reason.
24. No employees of any company or person connected with CH4 or the Competition shall be entitled to win the Prizes.
25. Notwithstanding the foregoing You agree not to apply for any injunctive relief and You accept that recovery of damages will provide a full and appropriate remedy for any loss or damage incurred by You.
26. This Competition is subject to the law of England and Wales and to the exclusive jurisdiction of the English courts.
