SMS Terms and Conditions:
1. This service is organised by Channel Four Television Corporation
"Channel 4" and its subsidiary 4 Ventures Limited both of
124 Horseferry Road, London SW1P 2YX. For the purpose of these terms
and conditions, any "We", "Us" and "Our"
mean Channel 4.
2. "You", or "Your" refers to you, the customer
and user of the Service. By using the Service You are deemed to have
accepted these terms and conditions.
3. The cost of each text alert sent to You by the Service will be
charged at the rate of 25p for O2, Orange and Vodafone network users.
T-Mobile and Virgin Mobile users will be charged £1.50 for every
7 messages. T-mobile and Virgin Mobile users may cancel the Alert
Package though no refund for part use is available.
4. Charges for the Service will be deducted from Your available credit
time if You are a pre pay customer or appear on Your monthly statement
if You are a pay monthly customer.
5. If you are not the bill payer, you must get permission from the
bill payer before subscribing.
6. You can cancel the Service at any time by sending MESSAGE OFF to
83188. T-Mobile users send MESSAGE OFF to 81188 to cancel the Service.
7. You acknowledge that You are only entitled to use the Service for
lawful purposes, for Your own personal, private use and will not use
the Service in breach of our or any third parties intellectual property
rights in the Service.
8. You recognise that the Service may, from time to time, be adversely
affected by events outside our control. We will make all reasonable
endeavours to ensure the uninterrupted and timely supply of the Service
and will take all reasonable steps at our expense to correct any error,
omission or mistake, but will be under no liability for any error
in, or delay in, or failure in transmission of the Service.
9. Components of the Service are supplied to us by third parties and
We can make no promises, express or implied as to the Service, including
but not limited to, its accuracy, relevance, or quality.
10. In addition, the Service is subject to the limitations of the
enabling technology on which it is reliant and may be adversely affected
by network performance and other operational factors beyond Our control,
including without limitation, congestion, network coverage, dropped
connections, the performance of Your wireless device and the maintenance
of secure network connections. We accept no responsibility if You
do not receive the Service for any of these reasons. These terms and
conditions will not affect Your statutory rights.
11. We will not be liable to You in any way for failures, defects
or delays in the delivery of the Service which are caused by one or
more of the following reasons: (a) You have provided an incorrect
phone number or other incorrect information before ordering a Service;
(b)Your phone does not support the Service; (c)Your message mail box
is full and has no additional memory to receive the download; (d)
Your phone is out of range or for some other reason can not be contacted
; (e) You accidentally erase a Service provided to You. In no event
shall We be liable for indirect, incidental or consequential damages,
including, without limitation, loss of income, data, or other information,
even if We has been advised of the possibility of such damages. In
no event shall our liability exceed the price paid for the Service.
12. If we believe that there has been a breach of these terms and
conditions we reserve the right to immediately and without notice
withdraw or bar the services.
13. Any personal data collected will be used solely in accordance
with current UK data protection legislation.
14. Channel 4 reserves the right to amend these terms and conditions
without prior notice. Any changes will be posted on this website.
15. These terms and conditions shall be governed by English law.
