Origination Terms and Conditions

The Origination project ("Project") is brought to you by 4 Learning, part of 4 Ventures Limited, and Culture Online. These terms and conditions set out the rules ("Rules") applying to the Project. By submitting an idea, you agree to be bound by these Rules.

Qualifying Entries

  • To qualify to participate in the Project you must be resident in the United Kingdom. All information submitted by you must be true, up to date and complete.
  • All entries must comply with the following Acceptable Use Policy. You are responsible for all content that submit as part of the Project. You agree not to:
  • submit content that is unlawful or otherwise objectionable, including information about illegal activities or promotes physical harm or injury against any group or individual;
  • submit content that you do not have a right to use, including information that is confidential, copyrighted or pirated
  • submit content containing nudity, pornographic material, or which is vulgar, profane or obscene;
  • impersonate any person or entity or a connection with a person or entity;
  • transmit any unsolicited or unauthorised advertising, promotional materials, "junk mail," "spam," or "chain letters";
  • submit material that contains software viruses or any other computer code, files or programs designed to interrupt or limit the functionality of any computer software or hardware or other equipment;
  • abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others;
  • collect or distribute personal data about other users without their consent.

We will pre-screen content and we have the right to refuse or move any content that you submit that violates this Acceptable Use Policy or that in our opinion is objectionable. We may remove your website and pursue other legal action if you breach these Rules.

Successful Ideas

Successful participants will be able to use their idea to build and run a website free of charge for 2 years. Successful ideas will be chosen according to the following criteria:

  • The idea is about the influences of any incoming culture on any aspect of Britain today.
  • The idea covers an area not previously addressed in the Project.
  • The idea explains what it is like to part of an incoming culture in Britain today.
  • The decision of 4 Learning shall be final.
  • If your idea is successful you will be able to build your own website according to your idea in conjunction with our partners Zyweb and Moonfruit (we will notify you which of our partners you are eligible to use). You can only build a website according to the idea you originally submitted.
  • Your website will remain live for 2 years from the date we notify you that your idea is successful. At the end of the 2 years, you may keep your website if you pay for the service (you will be charged at half price of the relevant charges at that time).
  • If your idea is successful we will email or write to you with contact details and a password to use the relevant services. Your use of these services is subject to the terms and conditions of either Zyweb or Moonfruit as applicable. You will also remain bound by the Acceptable Use Policy.
  • Successful participants names may be published on the Ideasfactory website or you can write to us including a self-addressed stamped envelope for a list of successful participants.
  • The award of your website is non-transferable and there is no cash alternative.

Permission to Use Your Idea

You will retain all rights in your idea, and your website if successful, but you acknowledge and agree that we may use your idea or website or any part of them for publicising the Project or the work of any of the Project partners, including Culture Online, Zyweb and Moonfruit, and you now give us permission to do so.

We may also wish to use your idea or your website to create a commercial product, such as a book, cd-rom or DVD and you now give us permission to do so subject to the retention of your rights as outlined above.

Liability

4 Learning does not accept any responsibility for any damage, loss, injury or disappointment suffered by any participant entering the Project.

4 Learning is not responsible for any problems or malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software failure of any email or entry to be received on account of technical problems or traffic congestion on the Internet, telephone lines or at any web site, including any injury or damage to the participant's or any other person's computer related to or from participation in the Project.

Your use of the website services is governed by the agreements you enter into with Zyweb or Moonfruit as applicable and 4 Learning does not accept any liability for your use of their services.

Nothing shall exclude 4 Learning's liability for death or personal injury as a result of its negligence.

Your privacy

Any personal data relating to entrants will be used solely in accordance with our Privacy Policy and will not be disclosed to a third party without the individual's prior consent.

Legal

4 Learning assumes that by submitting your idea you either have legal capacity to participate in the Project and agree to the Rules (i.e. that you are of sufficient age and mental capacity and are entitled to be legally bound in contract) or your parents have consented to your participation in the Project and use of these Rules.

4 Learning reserves the right to cancel or amend the Project or these Rules at any time without prior notice. Any changes will be posted on the Ideasfactory website.
