4LAUGHS COMPETITION TERMS & CONDITIONS

These terms and conditions together with any specific rules set out in Competition Notices (as defined below) are the Competition Rules ("Rules") and, unless expressly stated otherwise, they apply to competitions on the 4Laughs pages (as such pages may be rebranded from time to time) of the channel4.com website ("Competition"). By entering a Competition, entrants agree to be bound by these Rules and the terms of use of the website (which are available here).

IMPORTANT NOTICE

By providing content to Channel 4 or the website you confirm such content is (a) your own work and not copied from anyone else and (b) not defamatory, obscene, indecent, harassing or threatening. You must also have the consent of anyone featured in the content to provide this to Channel 4.

You will own content provided to Channel 4 or the website (unless agreed otherwise with you) but by providing content you agree that Channel 4 may make this content available on the website and any other media, which may include other internet sites, mobile, television or radio. Further details are set out below.

    WHO IS RUNNING THIS COMPETITION?

  1. The Competition is organised by Channel Four Television Corporation and/or its subsidiary 4 Ventures both of 124 Horseferry Road, London SW1P 2TX ("Channel 4").


  2. HOW DO THE RULES APPLY TO THE COMPETITION?

  3. Rules specific to each Competition are displayed in a notice on the www.channel4.com web page posting for such Competition (the "Competition Notice") and are incorporated into these terms and conditions. In the event of discrepancy between these terms and conditions and the Competition Notice, the Competition Notice shall prevail.
  4. Channel 4 reserves the right to cancel or amend the Competition, the Competition Notice or these Rules at any time without prior notice. Any changes will be posted either within the Competition Notice or these Rules. A copy of the Rules may also be obtained by sending a stamped addressed envelope (giving the name of the Competition) to: Competition Rules, Channel 4, 124 Horseferry Road, London SW1P 2TX.
  5. In the event of any dispute regarding the Rules, Competition Notice, conduct, results and all other matters relating to a Competition, the decision of Channel 4 shall be final and no correspondence or discussion shall be entered into.


  6. WHO CAN ENTER?

  7. To qualify to enter the Competition you must be resident in the United Kingdom and, unless the Competition Notice states otherwise, you must be aged 16 or over.
  8. Employees of Channel 4 or any company involved in the Competition or, if relevant, production of a television programme to which a Competition relates, or any advertising agency or web company connected with Channel 4 (or any such person's subsidiary or associated companies, agents or members of their families or households), are not eligible to enter the Competition. Channel 4 reserves the right to verify the eligibility of all entrants.
  9. There may be additional eligibility requirements for a specific Competition, e.g. a valid passport, visas and/or driver's licence will be required if the Competition prize includes travel outside the United Kingdom and/or car hire and you may need to provide verification of your identity.
  10. You confirm that all information you provide is true, current and complete.
  11. Channel 4 assumes that (and you confirm that) by using the website and entering the Competition either you have legal capacity to enter the Competition and agree to the Rules (i.e. that you are of sufficient age and mental capacity and are entitled to be legally bound in contract) or your parents have consented to your entry of the Competition and use of these Rules.
  12. Channel 4 reserves the right to disqualify any entrant if it has reasonable grounds to believe the entrant has breached any of these Rules. If any entrant is disqualified from the Competition, Channel 4 in its sole discretion may decide whether a replacement contestant should be selected. In this event, any further entrant will be selected on the same criteria as the original entrant and will be subject to these Rules.


  13. HOW DO YOU ENTER THE COMPETITION?

  14. Only one entry per person per Competition is allowed (unless stated otherwise in the Competition Notice).
  15. Competition entries must be made in the manner and by the closing date set out in the Competition Notice. If you don't do this, your entry will be disqualified.
  16. You don't have to buy anything to enter a Competition and there is no charge to register for use of the www.channel4.com website.
  17. Where participating in a Competition involves a premium rate telephone call, the Competition Notice will include details of the estimated length of the call and its anticipated cost, and any other guidance to which Channel 4 must adhere in compliance with ICSTIS rules. Where entry to a Competition is by premium rate telephone call, entry may also be made by post by writing (giving the name of the competition): Channel 4, 124 Horseferry Road, London, SW1P 2TX, to be received by the closing date as stated in the Competition Notice.
  18. Proof of posting cannot be accepted as proof of delivery. Channel 4 cannot accept responsibility for any lost or delayed entries or for any errors or defects in or unauthorised access to entries, which happen because of server functions, internet connectivity, communications systems, viruses, bugs or other things that Channel 4 does not control.
  19. Entrants should note that unless stated otherwise, Channel 4 does not accept responsibility for the return of any Competition entries, including those consisting of artistic or other material.


  20. THE EXCITING BIT - PRIZES...

  21. Prize winners will be chosen at random unless specified otherwise in the Competition Notice, from all qualifying entries and within 28 days of the closing date specified in the Competition Notice. Tie-breakers will be judged by Channel 4 and, if required by law, by an independent adjudicator. In all matters, the decision of the judge(s) and Channel 4 shall be final and no correspondence or discussion shall be entered into.
  22. Prize winners will be notified in the manner and within the time specified on the Competition Notice. Return of any prize notification as undeliverable or failure to reply as specified (and within the time stated) in the notification may result in disqualification and selection of an alternate winner. If more than one prize is awarded, only one prize per entrant will be awarded. Competition winner(s)' names may be published on the Channel 4 website or you can write to Competition Prize Winners, Channel 4, 124 Horseferry Road, London, SW1P 2TX (naming the specific competition) including a self-addressed stamped envelope for a list of winners.
  23. Claims for prizes must be made in the manner and within the time specified on the Competition Notice (or in the prize notification). Failure to claim a prize within this time or in the manner specified may result in disqualification and selection of an alternate winner.
  24. Prizes are non-transferable and there is no cash alternative. Channel 4 reserves the right to substitute prizes of equal or greater value at any time.
  25. Prizes are awarded at Channel 4's discretion and no prizes will be awarded as a result of improper actions by or on behalf of any entrant.
  26. Where a prize may not be appropriate for a younger contestant, the minimum age for entry will be stated in the Competition Notice and must be observed. Channel 4 reserves the right to request written proof of age of any winner.
  27. All taxes, insurances, transfers, spending money and other expenses (including meals or personal expenses upgrades etc.) as the case may be, unless specifically stated, are the sole responsibility of the prize winner.


  28. INTELLECTUAL PROPERTY RIGHTS - WHO OWNS WHAT?

  29. Any information submitted by you must be personal to and relate specifically to you. You confirm that the information and/or materials which you submit and/or distribute will be original and belong to you, will not infringe the intellectual property, privacy or any other rights of any third party, and will not contain anything which is defamatory, obscene, indecent, harassing, threatening, liable to incite racial hatred or which may constitute a contempt of court. If relevant, Channel 4 reserves the right, but not the obligation, to screen, filter and/or monitor information provided by you and to edit, refuse to distribute or remove the same.
  30. 4Laughs is committed to supporting new comedy and for this reason your entry will (unless we tell you otherwise in the Competition Notice) be owned by you. Each entrant hereby agrees that Channel 4 may make the entry available on the website and any other media, whether now known or invented in the future, which may include other internet sites, mobile, television or radio and that the entry may be made available with advertising or sponsorship. You now grant Channel 4 the right to use, display, publish, transmit, copy, edit, alter, store, re-format, sublicence and make available the entry for such purposes. Channel 4 will not make any other use of your entry without your permission.
  31. If we tell you we would like to own your entry then, in consideration of Channel 4 agreeing to consider entrants to the Competition, each entrant hereby assigns to Channel 4 the complete copyright and all other rights in any entry, which shall be for the full period of such rights. Channel 4 shall be free to use such rights and to assign such rights to third parties. If an entry can be submitted under a Creative Commons licence, we'll explain this to you at the time.



    IMPORTANT STUFF - CHANNEL 4'S LIABILITY

  32. Channel 4 cannot accept any responsibility for any damage, loss, injury or disappointment suffered by any entrant entering the Competition or as a result of accepting any prize. Channel 4 is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, providers, computer equipment or software, or failure of any email or entry to be received on account of technical problems or traffic congestion on the Internet, telephone lines or at any web site (or any combination of these things), including any injury or damage to the entrant's or any other person's computer or mobile telephone related to or resulting from participation or downloading any materials in the Competition. Nothing shall exclude Channel 4's liability for death or personal injury as a result of its negligence.


  33. YOU & YOUR INFORMATION

  34. Winners may be requested to take part in promotional activity and Channel 4 reserves the right to use the names and addresses of winners, their photographs and audio and/or visual recordings of them in any publicity.
  35. Any personal information Channel 4 obtains relating to entrants will be used solely in accordance with current UK data protection legislation and will not be disclosed to a third party without the individual's prior consent. Please see Channel 4's privacy policy for further details.


  36. JURISDICTION

  37. The Competition and the terms and conditions of this agreement will be governed by English law and you agree to the exclusive jurisdiction of the English courts.
