“Your first port of call and main point of contact throughout the creation of the business is your local Centre de Formalités des Entreprises (CFE). You can find a CFE in most organisations including the local Chamber of Commerce or Tax Office.
For an agricultural activity like winemaking, the Chambre d’Agriculture is the place to go. You will be guided through the various steps to follow, which include filling in the Formulaire MO – Declaration de Creation d’une Entreprise (MO) about your business and its status.
“Many companies are registered as a SARL (Société à responsabilité limitée) which is the equivalent of a limited company in the UK. The number of associates (directors) can be from one person or a moral entity in the case of a EURL (Entreprise Unipersonnelle à Responsabilité Limitée) to a maximum of 100. The responsibility of the associates is limited to the amount of capital that they contribute to the company. This is called ‘capital social’ and is usually seen by customers and trade partners as a gauge of the financial strength of a company.”
The CFE will give you advice on these matters. Once completed and returned to the CFE, the MO form is used to register your business with the appropriate authorities and organisations. These include the local chamber of commerce, tax office and social security office. The registration is fee about €84 (£67) including VAT at 19.6 per cent.
