SECURITY & LEGAL - HPI Guarantee Terms & Conditions

The HPI Guarantee is available for the benefit of HPI customers ("you") who undertake an 4Car HPI Check ("4Car HPI Check") with HPI Limited ("we" or "us"). The terms and conditions (the "Conditions") which apply to the HPI Guarantee are set out below.

Scope of Cover

The HPI Guarantee is designed to protect you against financial losses you suffer as a result of inaccurate or incomplete information ("the Loss") provided by us as part of an 4Car HPI Check you perform in relation to a vehicle. We will compensate you for the Loss, subject to these Conditions. To get the benefit of the HPI Guarantee, you must have carried out the 4Car HPI Check yourself. Please note that the HPI Guarantee does not warrant the condition of any vehicle.

Duration of cover

The HPI Guarantee is effective for a period of one year from the date of the 4Car HPI Check (the "Guarantee Period").

Definition of Loss

The Loss means:

  • any reduction in the market value of the vehicle; or
  • in the event of a failure to acquire good title to the vehicle either (at our sole option):-
    • the vehicle's market value; or
    • a sum necessarily paid or payable to acquire good title to the vehicle.

The Loss excludes any indirect or consequential loss you may suffer, or the loss of any actual or anticipated profit, capital or business. We do not take account of any item of improvement, including any addition or alteration, made to the vehicle by you.

For the purpose of quantifying the Loss, the market value of the vehicle will be calculated by reference to the purchase price paid for it or its retail value as evidenced by Parker's Guide, adjusted for its mileage and condition at the time of purchase, whichever is the lower. We reserve the right to inspect any vehicle which becomes the subject of a claim under the HPI Guarantee, at our own cost. Our decision on mileage and/or condition of the vehicle is final.

Limit of indemnity

The maximum limit of indemnity under the HPI Guarantee in respect of each Loss is £10,000, where you have supplied us with both the Vehicle Identification Number (VIN) and the Vehicle Registration Mark (VRM) at the time of your enquiry with us, prior to purchase of the vehicle.

Each claim will be subject to the following:

  • where your claim relates t failure to acquire good title, we will deduct 10% of the amount otherwise payable under the HPI Guarantee if you only supplied the VRM at the time of the enquiry; or
  • where your claim relates to a reduction in the market value of the vehicle, the HPI Guarantee will not exceed 20% of the market value of the vehicle, or £2,000, whichever is the lower.

Conditions - please read carefully before buying your vehicle

Before you buy the vehicle, you must do the following to qualify for the HPI Guarantee:

  • you must ensure that the vehicle is accompanied by a current registration document from the Driver and Vehicle Licensing Agency (the "V5");
  • you must check that all the vehicle information provided by us as part of the 4Car HPI Check matches the vehicle itself and the corresponding V5 and notify us of any discrepancies so that we can investigate. This information includes, but is not limited to, information we supply on the vehicle's make, model and derivative, engine size, colour, transmission, fuel type and door plan;
  • you must check that the date of first registration of the vehicle we provide as part of the 4Car HPI Check matches the date on the corresponding V5;
  • you must check that all the VIN markings on the vehicle match each other and the corresponding V5; and
  • you must obtain, and provide to us on request, a written statement or receipt signed by the seller of the vehicle containing details of the seller's name and address, the identity and mileage of the vehicle purchased, the date of purchase of the vehicle and the amount paid by you for the vehicle.

Exclusions

Please note that information we provide on a vehicle's description, value, mileage and accompanying documentation (such as its MOT) is not covered by the HPI Guarantee.

The HPI Guarantee will not apply if:

  • you conduct the 4Car HPI Check after buying the vehicle;
  • we have not received full payment for the 4Car HPI Check before you buy the vehicle;
  • your claim arises from an event that occurred after the 4Car HPI Check was carried out;
  • the vehicle is registered outside mainland Britain at the time of conducting the 4Car HPI Check. Please note that vehicles registered in Northern Ireland are not covered by the HPI Guarantee;
  • you buy the vehicle outside mainland Britain, for example if you source it yourself from mainland Europe or from Northern Ireland;
  • you intentionally supply us with incorrect or incomplete information, or do not co-operate with us and our agents (and, in any case involving stolen vehicles, the police) in progressing your claim under the HPI Guarantee;
  • you provide us with a VRM and a VIN and we advise you that the two do not relate to the same vehicle; or
  • you are actually aware at the time of your Enquiry of certain information relating to the vehicle (including without limitation that the vehicle is stolen, is an insurance "write-off" or is subject to an outstanding encumbrance or security interest) which subsequently forms the basis of your claim under the HPI Guarantee.

If a vehicle is recorded on our Condition Inspected register, you cannot make a claim under the HPI Guarantee based on any deemed reduction in value of that vehicle as a result of that vehicle having previously been included on the Condition Alert register.

HPI's data sources are UK-based. Therefore, if the vehicle has been previously registered in another country, the 4Car HPI Check will only reveal information relating to the period after it was first registered in mainland Britain. Accordingly you cannot make a claim under the HPI Guarantee for any Loss resulting from the vehicle having been previously registered outside mainland Britain or any event which occurred prior to first registration in mainland Britain (whether or not the 4Car HPI Check displays an import marker in relation to the vehicle).

Claims Procedure

If you wish to make a claim under the HPI Guarantee, you must inform us as soon as possible after you become aware of the events giving rise or potentially giving rise to the claim (and in any event within the Guarantee Period).

We will issue a claim form for you to complete and return, together with evidence of the 4Car HPI Check, your proof of purchase and other relevant documentation.

Miscellaneous

  • The HPI Guarantee is personal to you; you may not assign it to anyone else.
  • Nothing contained in these Conditions is intended to affect nor will it affect any of your statutory rights if you are a consumer (within the meaning contained in the Unfair Contract Terms Act 1977).
  • Any failure by us to exercise or enforce any right under these Conditions will not constitute a waiver of that right nor prevent us exercising or enforcing it or any other right we may have at any subsequent time or times.
  • If any provision of these Conditions is held by a court or administrative body of competent jurisdiction to be unenforceable, the validity of the other provisions of these Conditions will not be affected.
  • The formation, existence, construction, performance, validity and all aspects of these Conditions shall be governed by English law and the parties submit to the exclusive jurisdiction of the English courts.
